Terms of Service

Plain language, no surprises. By using Kink Haus, you agree to these terms. Please read them.

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Gale Libera, the individual operator of Kink Haus ("the Service", "I", "me"). By accessing or using the Service, creating an account, or clicking to accept these Terms, you agree to be bound by them. If you do not agree, you must not use the Service.

2. Eligibility

To use the Service you must meet all of the following requirements:

  You are at least 18 years of age, or the age of majority in your jurisdiction, whichever is greater.

  You are legally permitted to access adult-oriented content under the laws of your jurisdiction.

• ▶

  You are acting on your own behalf and not for any commercial purpose.

• ▶

  You are not prohibited from receiving services under applicable law.

• ▶

  By registering for an account, you represent and warrant that all of the above are true.

3. Account Registration

When you create an account you agree to:

  Provide accurate information during registration (an email address you control and a password).

• ▶

  Maintain the confidentiality of your credentials and not share your account with any third party.

• ▶

  Notify me at gale@kink.haus promptly if you believe your account has been compromised.

• ▶

  Accept responsibility for all activity that occurs under your account.

• ▶

  You are strongly encouraged to use a pseudonym and an email address that does not contain personally identifying information.

4. Your Content and Licence

You retain full ownership of content you create using the Service. By submitting content you grant me a limited, non-exclusive, royalty-free licence to store, host, and display that content solely for the purpose of providing the Service to you. This licence terminates when you delete the content or your account. You represent and warrant that:

  You own, or have the necessary rights to, all content you submit.

• ▶

  Your content does not infringe the intellectual property, privacy, or other rights of any third party.

• ▶

  Your content does not depict or facilitate illegal activity.

• ▶

  You will not upload content that sexualises, exploits, or endangers minors. Any such content will be immediately removed and reported to the relevant authorities.

5. Prohibited Conduct

You agree not to engage in any of the following:

  Upload, post, or transmit content that is illegal, harmful, hateful, or that promotes violence, discrimination, or non-consensual acts.

• ▶

  Harass, threaten, stalk, intimidate, or humiliate any person without their explicit consent.

• ▶

  Attempt to gain unauthorised access to any part of the Service, its servers, databases, or other users' accounts.

• ▶

  Introduce malware, viruses, or any malicious or disruptive technology into the Service.

• ▶

  Scrape, crawl, or extract data from the Service using automated means without prior written permission.

• ▶

  Impersonate any person or entity, or falsely state or misrepresent your identity or affiliation.

• ▶

  Use the Service for any commercial purpose, including advertising, affiliate marketing, or data harvesting.

• ▶

  Attempt to reverse engineer, decompile, or disassemble any portion of the Service.

6. Intellectual Property

All rights in the Service itself — including its design, code, branding, text, and non-user-generated content — are reserved by Gale Libera. Nothing in these Terms transfers any intellectual property rights to you. You are granted a limited, revocable, non-transferable licence to use the Service for personal, non-commercial purposes in accordance with these Terms.

7. Disclaimer of Warranties

The Service is provided on an "as-is" and "as-available" basis without any warranty of any kind, express or implied. To the fullest extent permitted by applicable law, I disclaim all warranties including but not limited to:

  Warranties of merchantability, fitness for a particular purpose, and non-infringement.

• ▶

  Any warranty that the Service will be uninterrupted, error-free, secure, or free of harmful components.

• ▶

  Any warranty regarding the accuracy, reliability, or completeness of any content on the Service.

• ▶

  Kink Haus is a personal project maintained by a single developer. Downtime, bugs, and data loss — while undesirable — are possible.

8. Limitation of Liability

To the fullest extent permitted by applicable law, I shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Service, including but not limited to loss of data, loss of profits, reputational harm, or personal injury. In no event shall my total liability to you for all claims exceed the greater of one hundred US dollars (USD $100) or any amounts you have paid in the twelve months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Gale Libera from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights.

10. Account Suspension and Termination

I reserve the right to suspend, restrict, or permanently terminate your account at my sole discretion, with or without notice, if I believe you have violated these Terms or engaged in conduct harmful to the Service or its users. Upon termination:

  Your access to the Service will be immediately revoked.

• ▶

  Your account data may be deleted in accordance with the Privacy Policy.

• ▶

  You may request account deletion at any time from Account Settings regardless of any dispute.

11. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with applicable law. Any dispute arising from or relating to these Terms or the Service that cannot be resolved by informal negotiation shall be subject to the exclusive jurisdiction of a competent court. Nothing in this section prevents either party from seeking injunctive or equitable relief.

12. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions shall continue in full force and effect.

13. Changes to These Terms

I reserve the right to modify these Terms at any time. Material changes will be indicated by updating the "Last Updated" date at the top of this page. Your continued use of the Service following the posting of revised Terms constitutes your acceptance of those changes.
